| Résumé: | الخلع، هذه الظاهرة الشرعية والقانونية من الظواهر المجتمعية التي تنامت بشكل متسارعا في السنوات الأخيرة، (20 ألف حالة في 2013). هي اليوم واقع تعيشه الأسرة الجزائرية في ظل التحولات السوسيو-ثقافية والاقتصادية المتواترة. يجب التعامل معها-لأبعادها الخطيرة – إذ سادت بين أبناء المجتمع لا شك تساعد على انهيار البناء الاجتماعي والتفكك الأسري والتحلل من القيم المدعمة للبناء الاجتماعي. (أغلب الآفات الاجتماعية التي نراها اليوم من مخدرات وتشرد وانحلال خلقي كان الطلاق والتفكك الأسري من أهم أسبابها). وإذا كان حدوث الطلاق مرهونا بأسباب مقنعة في نظر الشريعة وأمام القانون فما حقيقة الخلع؟ ما الذي يجعل الزوجة تصر على خلع زوجها؟ هل للظروف المادية وتحولات المجتمعة دخل في ذلك...؟ وما أثر ذلك على استمرارية الأسرة وتماسكها؟ هذا ما نحاول في هذه الورقة البحثية تبيانهبالتحليل للوقوف عن طبيعة هذه الظاهرة أسبابها وأبعادها المختلفة على المجتمع الجزائري |
| Description: | ةالع: سبابوثار Khula, this legal and jurisprudential phenomenon, is one of the societal phenomena that has developed rapidly in recent years (20,000 cases in 2013). Today, the Algerian family lives in the light ofrecurrent social, cultural and economic transformations. . It must be dealt with - due to its dangerous dimensions - If it spreads among the members of the community which certainly contributes to the collapse of the social structure, the disintegration of the family and the disintegration of the values on which rests the social structure. (Most of the social ills we see today, including drugs, the homeless, and moral degeneration, of which divorce and family disintegration were among the most prominent causes).
