Résumé:	يعد الاستثمار في العقار الفلاحي أحد المحركات الأساسية للتنمية، شريطة توفر البيئة أو المناخ الملائم بإطاره التشريعي، فدعم الاستثمار بصورة دائمة ومستمرة، فرض على الجزائر إعادة النظر في طريقة تسيير واستغلال العقار عموما بما فيه العقار الفلاحي ، وقد عرفت عملية استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة ، تطورا تشريعيا وتعاقبت النصوص القانونية، التي تضبط العقار الفلاحي بدء بقانون التسيير الذاتي 86/653 وصولا إلى قانون 10/03 المحدد لشروط وكيفيات استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة.
Description:	The Investment in the agricultural real estate is regarded as one of the basic engines of development, provided that the environment or the appropriate climate is an adequate in its legislative framework. In order to support the investment permanently and continuously, Algeria was forced to rethink about the way in which the property is managed and used in general, including the agricultural real estate. The process of exploiting the agricultural lands which belonged to the private state’s property has been known a legislative development, and a progression of the legal texts which regulate the agricultural property, it started with the law of self-management 86/653, up to 10/03 law that specified the terms and modalities of exploitation of the agricultural land which belonged to the private property of the state.
