dc.description	Construction is considered as one of the individual’s rights whether it was natural or moral. And by reference to the Algerian legislation,a great importance has been given to this right, and its exercising but within a number of duties or obligations Some important consequences can be cited as follows: - The preventive characteristic of building permission. - The protection from dangerous and polluted buildings which affect the public system with all its elements. - Protect others from any damage by imposing fencing on the constructor as well as the creation of designs by qualified architect. - Ensure management control through field visits , as well as the necessity of sending reports by the constructor about the construction process. - The builder will be responsible for any breach of duties. dc.description.abstract	يعتبر البناء حقا من حقوق الشخص سواء كان طبيعيا أو معنويا، وبالرجوع للتشريع الجزائري نجده قد أولى أهمية كبيرة بهذا الحق، وجعل ممارسته لا تتم إلا في إطار احترام جملة من الواجبات أو الإلتزامات خاصة اتجاه الإدارة، الأمر الذي يؤدي إلى مجموعة من النتائج ذات الأهمية الكبرى والتي تتجلى أساسا فيما يلي: - الطابع الوقائي لرخصة البناء. - حماية البيئة من البنايات الخطرة والملوثة والمؤثرة على النظام العام بكل عناصره. - حماية الغير من الإصابة بأي ضرر بإلزام الباني على التسييج، وكذا إنشاء التصاميم من قبل مهندس معماري معتمد. - ضمان رقابة الإدارة من خلال الزيارات الميدانية وكذا وجوب إرسال الباني لتقارير عملية البناء. - قيام مسؤولية الباني على أنواعها في حالة إخلاله بواجباته.	en_US
