| Résumé: | ان قانون التعمير مجموعة من ضوابط وقواعد وإجراءات هدفها تنظيم المجال العقاري لمنع أي عملية بناء تخالف الضوابط المعمول بها، وكما يحدد قانون التعمير المعايير والاسس التي ينبغي على الأشخاص المعنية به التقيد بها، يحدد كذلك قائمة المخالفات التي تنتج عن عدم التقيد بالقانون وبالتبعية توقيع الجزاء على منتهكي قانون التعمير، وقد جاء المشرع الجزائري بعدة مخالفات للتهيئة والتعمير، حاولنا الالمام بها في هذه الورقة البحثية، من خلال التطرق الى المخالفات التي وردت في قانون التهيئة والتعمير، وقانون الترقية العقارية، وكذا المخالفات التي تناولها قانون تسوية البنايات. لكن مخالفات التهيئة والتعمير المنصوص عليها قانونا تبقى بدون جدوى ان لم يتم احداث وسائل لمراقبتها ومعاينتها وتوقيع عقوبات على منتهكي قانون التعمير لذا من اللازم علينا دراسة وسائل مراقبة مخالفات قوانين التهيئة والتعمير من خلال التطرق الى القوانين المتعلقة بشروط وكيفيات تعيين الأعوان المؤهلين للبحث عن مخالفات التشريع والتنظيم في مجال التهيئة والتعمير ومعاينتهما وكذا إجراءات المراقبة، وكل ما يخص مهام المفتشية العامة للعمران والبناء وتنظيمها وعملها، إضافة الى إنشاء المفتشية الجهوية للعمران والبناء وتحديد مهامها وعملها. |
| Description: | The construction law is a set of rules and procedures created for the main objective, which is regulating the real estate domain to prevent any illegal construction as the law defines the recognized norms to be complied by the persons; it also specifies the list of violations resulting from non-compliance with the law. The Algerian legislator created some irregularities in case of the preparation and reconstruction, which we tried to know in this research, by recognizing the irregularities mentioned in the Law of Planning and Construction as well as the way to deal with the violations by the Law on the settlement of buildings. However, these violations remain with no effects if there are no monitoring and punishment towards the violation of the law. Therefore, it is necessary for us to study the means of monitoring the violations of the laws of preparation and reconstruction by addressing the laws related to the conditions of appointing qualified personnel to search for violations of legislation and regulation In addition to the establishment of the Regional Inspectorate for Building and Construction. |
