| Résumé: | لقد أثبث الواقع أن الميكنزمات القانونية لقواعد المسؤولية المدنية طبقا للقانون المدني ، أنها لم تعد تستوعب تطور نظام المسؤولية المدنية وخاصة مسؤولية المهنيين كمهنة المرقي العقاري ، لما تمتاز به هذه المسؤولية من أنها تتجاذبها مجموعة من القوانين بالزيادة على قواعد التقنين المدني هناك قواعد قانون حماية المستهلك ،وكذلك القواعد القانونية التي يتضمنها قانون 11/04 المحدد للقواعد المنظمة لنشاط الترقية العقارية، أمام كل هذا التجادب بين القوانين في تحميل المرقي العقاري للمسؤولية المدنية ،يجيب مقالنا على فكرة عامة وهي هل تصمد المسؤولية المدنية للمرقي العقاري أمام تطور نظام المسؤولية المدنية؟ |
