| dc.description.abstract | قد تقتضي حماية الحق المتنازع عليه اللجوء إلى القضاء، ومن أجل ذلك اشترط القانون على المتقاضي إتباع قواعد قانونية موضوعية وأخرى إجرائية لكي يستطيع المتضرر الحصول على حقه. يعد شهر الدعاوى العقارية الوسيلة القانونية الإجرائية المقررة لحماية الملكية العقارية ، ومابين موقف مؤيد ومعارض للقضاء الجزائري حول إلزامية هذا الاجراء استقر الامر على ضرورة شهر الدعاوى العقارية ، غير أنه وحسب مختلف القوانين التي تنظم الوعاء العقاري فإن نطاق هذه الدعاوى قد يضيق أحيانا لتقتصر على بعض الدعاوى العقارية وقد يتسع أحيانا ليشمل الكثير من الدعاوى المتعلقة بالتصرفات العقارية | en_US |
