| dc.description.abstract | يعتبر القطاع الفلاحي من أهم القطاعات الرئيسية بالنسبة لدول العالم – بما فيها الجزائر- نظرا لما يحققه من اكتفاء ذاتي وأمن غذائي.ولتحقيق هذا الهدف، تسعى الدول جاهدة إلى الاهتمام بالقطاع الفلاحي، والأراضي الفلاحية من أجل ضمان نموها الاقتصادي وتطورها الاجتماعي، ولا يتأتى لها ذلك إلا عن طريق الاستثمار في القطاع الفلاحي. وتعتبر عقود الامتياز الفلاحي التي تمنحها الدولة للمستثمرين أصحاب الامتياز مظهرا من مظاهر الاستثمار في القطاع الفلاحي، ونظرا لأهميتها عمدت الدولة الجزائرية إلى تنظيمها بموجب القانون رقم 10/03 المحدد لشروط وكيفيات استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة، والذي جاء من أجل الوصول إلى استقرار العمل في مجال الاستثمار الفلاحي والحفاظ على الأملاك الوطنية. وستقتصر دراستي في هذا المقال على تحديد آثار عقد الامتياز الفلاحي بالنسبة للمستثمر صاحب الامتياز، وذلك بالتطرق إلى حقوقه والالتزامات المترتبة عليه | en_US |
