Résumé:	أرسى المشرع الجزائري من أجل تنظيم عملية البناء والتشييد والمحافظة على نسق عمراني متجانس ضرورة الحصول على رخصة البناء بإتباع الإجراءات والشكليات المتطلبة ضمن قانون التهيئة والتعمير 90/29 المؤرخ في 01/12/1990 وكذا المرسوم التنفيذي رقم 15/19 المؤرخ في:25/01/2015 والمتضمن عقود التعمير، ففي ظل هذا الأخير سعى المشرع إلى ضبط جملة من الإجراءات الخاصة بالرخص والشهادات العمرانية التي عرفت في ظل هذا المرسوم بعقود التعمير،فعملية تشييد البنايات تخضع لضرورة حصول مالك أو حائز الأرض على رخصة البناء،وفي حال الإنتهاء من أشغال البناء يتوجب الحصول على شهادة مطابقة البناء لرخصة البناء والتي تعد أداة رقابية بعدية على ملاءمة البناء المشيد للسكن،وترخيصا إداريا لاستعمال البناء المشيد لاستقبال الجمهور والمستخدمين إذا كان البناء مخصصا لتقديم خدمات للجمهور. لذا سنتطرق من خلال هذه الورقة البحثية إلى ضبط المخالفات والمنازعلت التي تثيرها شهادة المطابقة، ومعرفة سبل تسوية هذه المنازعات والقضاء المختص بالفصل فيها.
Description:	The Algerian legislator, in order to organize the building and construction process and to maintain a homogeneous layout, established the necessity of obtaining a building permit by following the procedures and formalities required under the Planning and Construction Law 90/29 of 01/12/1990 as well as Executive Decree No. 15/19 of 25/01 Which includes reconstruction contracts. In light of this, the legislator sought to control a number of procedures related to the licenses and building certificates that were defined under this decree in the construction contracts. The construction of the buildings is subject to the necessity of obtaining the building permit. A certificate of building conformity must be obtained Building permit, which is a regulatory tool dimensionality on the suitability of building constructed for housing, and a license for the use of administrative building, built to receive the public and users if the building dedicated to the provision of services to the public. Therefore, we will discuss through this paper the control of violations indoor raised by the certificate of conformity, and find out how to settle these disputes and the judiciary competent to adjudicate.
