Résumé: أدى التطور التكنولوجي إلى ظهور العولمة المصرفية. وهذا ما دفع بالبنوك التجارية إلى حتمية تطوير
است ا رتيجيتها وتبني وسائل الدفع الإلكتروني بدل وسائل الدفع التقليدية لتتمكن من تقديم خدمات مصرفية جديدة
تتلاءم مع طبيعة العمليات والصفقات الإلكترونية، بحيث أنه هناك العديد من وسائل الدفع الإلكتروني التي
تصدرها البنوك التجارية لا يتم بموجبها تنفيذ العقود والالت ا زمات المترتبة عن العلاقات القانونية التجارية من
بيع سلع وتقديم خدمات عبر الإنترنت. إلا أن هذه الوسائل محاطة بالعديد من المخاطر التي تقف عائقًا أمام
تطورها ولا بد من مكافحتها لتنفيذ المبادلات التجارية بفاعلية، ومن جهة أخرى فإن التعامل بوسائل الدفع
الإلكتروني يرتب مسؤولية قانونية تقع على عاتق كل طرف في حالة الاستعمال غير المشروع أو الإخلال

Description: Technological advancement has led to the emergence of banking globalization,
which has compelled commercial banks to inevitably develop their strategies and
adopt electronic payment methods instead of traditional ones. This enables them to
provide new banking services that align with the nature of electronic transactions
and operations. Indeed, many electronic payment methods issued by commercial
banks are used to execute contracts and fulfill obligations arising from legal
commercial relationships, such as the sale of goods and the provision of services
over the internet. However, these methods are surrounded by numerous risks that
hinder their development, and these risks must be addressed to ensure the effective

Résumé: هدفت هذه الدراسة الى تسليط الضوء على اهمية تنظيم نظام المساعديين القضائيين في التشريع الجزائري بالنظر الى الدور المحوري الذي تؤديه هذه الفئة في دعم العدالة وضمان فعالية الجهاز القضائي وقد تناولت الدراسة مختلف المهن التابعة لهذا النظام ، بما في ذلك المحضرالقضائي ، المحامي، الموثق، المترجم، الخبير، ومحافظ البيع بالمزاد العلني سابقا، من خلال تحليل الإطار القانوني الذي ينظم شروط التعيين، ضوابط الممارسة، والالتزامات الأخلاقية والمهنية التي تحكم سلوكهم.
Description: This study aimed to highlight the importance of regulating the judicial assistants’ system in Algerian legislation, given the essential role this group plays in supporting justice and ensuring the efficiency of the judiciary ,The research covered various professions within this system, including bailiffs, lawyers, notaries, translators, experts, and public auction officers, analyzing the legal framework that governs appointment conditions, professional practice standards, and ethical obligations.
It also emphasized the types of legal responsibilities imposed on these assistants—civil, for damage caused; criminal, in cases involving public order or breach of trust; and disciplinary, when professional duties are violated.

Description: The process
of digital access to administrative decisions is the result of the shift
toward e administration in light of the development of communications
technology. The administration has relied on modern means and technologies to
communicate the content of its administrative decisions to itsrecipients in a rapid
and effective manner, in contrast to the previous traditional administration, which
relied on paper based administrative transactions. Thus, this study demonstrated the
impact of the technological transformation on the legal sys tem related to the validity
of the decision and the beginning of itseffects, both for the administration and
individuals. We reached fundamental conclusions, the most important of which is
that digital access to administrative decisions facilitates notific ation to the
